Data Privacy & Protection in Digital India: The Future and Next Steps

There is no privacy without security. But security alone is not enough to protect your customer’s sensitive data. Strong privacy protection enables you to unlock data for new purposes and makes the job of the security team a lot easier.

India currently does not have any express legislation governing data privacy and protection. While the transition to a digital economy is underway, the processing of personal data has already become omnipresent.

In December 2019, the government introduced the Personal Data Protection Bill, 2019, which would create the first cross-sectoral legal framework for data protection in India. The bill is largely modelled on the GDPR and aims to protect the informational privacy of individuals by creating a preventive framework that regulates how businesses collect and use personal data.

  • The relevance of a Data Protection Law in pre and post Covid-infected India in terms of protecting sensitive information?

  • Whether the existing Information Technology Act is an adequate safeguard to prevent data security threats?

  • What are the loopholes underlying the current legislative framework in India in terms of data protection?

  • Personal Data Protection Bill - a myth or reality in near future? What the reason of its longstanding non-enforcement?

  • What are the challenges and safeguards available in case of breach arising from those schemes?

  • Global Privacy Law - how can India be benefitted from it?

  • A dilemma on extraterritorial jurisdictions: how digital India can resolve the jurisdictional issues in data protection sphere?

02:00 PM – 02:05 PM (IST)
