AI-based tools can assist patent practitioners with routine drafting tasks, such as drafting backgrounds and high-level summaries, when used with appropriate oversight.

 

At the same time, their use in patent preparation and prosecution presents important limitations that warrant careful consideration. In drafting, observed issues can include factual inaccuracies, hallucinations, and the like. In prosecution, AI-generated strategies may be imprecise or insufficiently tailored to the point of novelty. Claim charts may also require verification, and portfolio comparisons are often based on broad CPC classifications rather than detailed claim analysis.

 

Accordingly, while AI tools can be helpful in certain contexts, their outputs benefit from careful attorney review. Thoughtful use and appropriate oversight remain essential, particularly for substantive legal analysis and prosecution strategy.
